It's the weekend and therefore time for a look at the cases that have recently come before Cornwall's magistrates. Everyone who has been charged with an offence, from the least to the most serious, appears initially before the magistrates.

The most serious cases are then sent to the crown court. If a defendant pleads guilty, they could be sentenced straight away or have the matter put back for a pre-sentence report. If they deny the allegations against them, the case will be adjourned for a trial.

The courts are open to anyone and our reporters attend just like any other member of the public. As most people have jobs and cannot spend their time in court, the media has always acted as the eyes and ears of the public to ensure that justice is seen to be done.

Here's who has been sentenced at the magistrates' court in Bodmin and Truro recently.

Hugo Santa

Age: 42

Castle Street, Bodmin

Drive a motor vehicle otherwise than in accordance with a licence. On June 23, 2024 at Bodmin drove a motor vehicle, on Castle Street, otherwise than in accordance with a licence authorising him to drive a motor vehicle of that class.

Also on the same day and in the same place, drove a vehicle without a valid MOT certificate, without third party insurance and also drove a motor vehicle with a proportion of a specified controlled drug above the specified limit, Contrary to section 5A(1)(a) and (2) of the Road Traffic Act 1988 and Schedule 2 to the Road Traffic Offenders Act 1988, namely 4.2 microgrammes per litre, exceeded the specified limit.

Possess knife blade / sharp pointed article in a public place. On October 4 last year at Newquay police station had with him, without good reason or lawful authority, an article that has a blade, namely a kitchen knife.

On the same day at Newquay, when suspected of having driven a vehicle and having been required to provide a specimen of blood for a laboratory test pursuant to section 7 of the Road Traffic Act 1988 in the course of an investigation into whether he had committed an offence under section 3A, 4, 5 or 5A thereof, failed without reasonable excuse to do so.

Suspended sentence order: eight weeks, supervision period: two Years. Unpaid work: 200 hours. Obligatory disqualification: two years. Costs: £85. Surcharge: £154.

Age: 29

Bullens Lane, St Ives

On January 4, 2024, in Truro, stole a quantity of alcoholic beverages to the value of £390 belonging to Tesco.

On July 2 last year, again in Penzance jointly with another stole a quantity of branded clothes to the value of £770 belonging to Sports Direct.

On July 17 last year, stole alcohol to the value of £360 again from the Tesco store in Penzance. On July 29, 2024, in Penzance stole Pokemon cards to the value of £120 belonging to Ryman Store. The next day, again stole Pokemon cards worth £24.75 from the same shop.

Two days before, also in Penzance, stole 14 bottles of spirits to the value of £403 belonging to Tesco.

On August 1, 2024 at Pool stole £300 worth of alcohol belonging to Tesco. Theft from a shop. On August 23, at Penzance stole trading cards to the value of £105 belonging to Game-On Cornwall.

On August 28 last year stole alcohol worth £42.10 from Asda Express in Penzance. The previous day, jointly with another, having entered as a trespasser a building, namely The Lugger Inn in Penzance stole alcoholic and soft drinks.

In addition, on October 5, entered as a trespasser the Longboat Hotel on Market Jew Street in Penzance and stole therein a TV set, a set of keys and a camera lens in a black case and a Shure headset.

Suspended sentence: 30 weeks, suspended for two years. Mental health treatment: 12 months. Rehabilitation activity: 20 days. Compensation: £2,000.

Anne-Marie Kent

Age: 59

Prospect Gardens, Truro

Arson. On September 28, 2024 at Chapel Street in Camborne, committed arson in that without lawful excuse she damaged by fire curtains, a window area and the property in general to the value of £14,736 belonging to a man intending to destroy or damage such property or being reckless as to whether such property would be destroyed or damaged.

Compensation - Amount of compensation: £500. Suspended sentence order: 6 months. Suspended for 18 months.

Thomas Smale

Age: 35

Park An Daras, Helston

Possess knife blade / sharp pointed article in a public place. On January 10 at Helston had with him, without good reason or lawful authority, in a public place, namely Rowes Lane in Helston, an article which had a blade or was sharply pointed, namely a large black kitchen knife.

Remanded in custody until February 11.

Christopher Maybank

Age: 38

Truro Road, St Austell

Harassment - put in fear of violence. Between December 9 and December 31 at Redruth caused a woman to fear that violence would be used against her by his course of conduct which he knew or ought to have known would cause fear of violence to this woman on each occasion in that on at least two occasions, between these dates he attended her home address, called and texted on numerous occasions, making threats to harm her.

Suspended sentence order: 24 Weeks, Supervision period: 24 Months. Alcohol abstinence and monitoring: 120. Mental health treatment: 12 Months. Programme - Number of days: 30 Days, Additional information: Building Choices. Rehabilitation activity: 10 Days. Restraining order not to go to an address in Redruth.

Costs to Crown Prosecution Service: £135.

Age: 31

Quintrell Close, Quintrell Downs

Speeding - exceed 30 mph on restricted road in England. On July 23, 2024 in Newquay drove a motor vehicle on A3058 Henver Road, at a speed exceeding 30 miles per hour. Measured speed was 51mph.

Points disqualification: Six Months. Notional penalty points: Six. Fine - Amount of fine: £120. Costs: £90. Surcharge: £48.

Harry Hawken

Age: 28

Fore Street, Praze, Camborne

Exceed 30 mph speed limit in contravention of a Local Traffic Order. On October 6, 2024 at Truro drove a motor vehicle on an unclassified road at Bissoe.

Points disqualification - Disqualification period: Six Months, Notional penalty points: Six. Fine: £333. Costs: £90. Surcharge: £133.

Anna Hamilton

Age: 55

Church Lane, Truro

Drive motor vehicle with a proportion of a specified controlled drug above the specified limit, Contrary to section 5A(1)(a) and (2) of the Road Traffic Act 1988 and Schedule 2 to the Road Traffic Offenders Act 1988.

On July 2, 2024 at Truro, drove a motor vehicle on Oak Way, when the proportion of a controlled drug, namely cocaine, in her blood, namely greater than 32 micrograms per litre, exceeded the specified limit.

Community order. Mental health treatment: 12 Days. Obligatory disqualification: 12 Months. Fine: £120. Costs to Crown Prosecution Service: £85.00. Surcharge: £114.

Worvas Lane, Ruan Minor

Drive motor vehicle with a proportion of a specified controlled drug above the specified limit.

On July 26, 2024 at Helston drove a motor vehicle on Clodgey Lane when the proportion of a controlled drug, namely Delta-9-tetrahydrocannabinol, in his blood, namely not less than 5.0micrograms of drug per litre of blood, exceeded the specified limit.

Obligatory disqualification: 12 Months. Fine: £120. Costs to Crown Prosecution Service: £85. Surcharge: £48.

Portloe

Drive motor vehicle when alcohol level above limit. On November 30, 2024 at Ruan High Lanes drove a motor vehicle on the A3078 Ruan High Lanes after consuming so much alcohol that the proportion of it in his breath, namely 72 microgrammes of alcohol in 100 millilitres of breath, exceeded the prescribed limit.

Use a motor vehicle on a road / public place without third party insurance. On the same at Ruan High Lane used a motor vehicle, the same road when there was not in force in relation to that use such a policy of insurance as complied with the requirements of Part VI of the Road Traffic Act 1988

Mental health treatment: 12 Days. Driving Disqualification: 40 months. Fine: £369.

Redruth Highway, Redruth

Drive a mechanically propelled vehicle on a road / in a public place without due care and attention. On October 11 last year in Redruth drove a mechanically propelled vehicle on the A30 without due care and attention. Also drove a motor vehicle without due third party insurance.

Discretionary with ordinary disqualification - Disqualification period: 6 Months. Fine: £300.
